The terms that govern your use of HiTranscript.

1. Acceptance of These Terms
These Terms of Service (the "Terms") govern your access to and use of the HiTranscript website, our transcription tools, and related services (collectively, the "Service") provided under the HiTranscript brand ("HiTranscript," "we," "us," or "our").
By creating an account, purchasing credits, submitting content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Eligibility
The Service is not intended for children under 13. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian, who is responsible for your use of the Service.
You may not use the Service if applicable law prohibits you from receiving or using it.
3. The Service
HiTranscript lets users submit supported public URLs or upload supported audio and video files to generate transcripts, timestamps, detected speaker information, subtitles, and related exports.
The Service supports only sources and formats made available through the current product. HiTranscript does not bypass logins, private accounts, paywalls, access controls, or technical protection measures.
HiTranscript is an independent service and is not affiliated with, sponsored by, or endorsed by Instagram or any other third-party platform. Third-party platforms may change or discontinue access at any time, which may affect the Service.
We may add, modify, suspend, limit, or discontinue features. Where reasonably practicable, we will provide notice before a material discontinuation of paid functionality.
4. Accounts
You must provide accurate and current account information. You are responsible for safeguarding your credentials and for all activity under your account, except to the extent caused by our breach of applicable obligations.
You may not share, sell, transfer, or allow unauthorized use of your account. Notify us promptly at support@hitranscript.com if you suspect unauthorized access.
5. Your Content
"Your Content" means URLs, audio, video, text, files, metadata, instructions, edits, speaker labels, and other material you submit to the Service.
You retain any ownership rights you have in Your Content. You grant HiTranscript a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, transcode, modify for technical compatibility, and otherwise process Your Content solely as reasonably necessary to:
- Provide, operate, secure, troubleshoot, and support the Service.
- Generate and deliver transcripts, timestamps, subtitles, previews, and exports you request.
- Use service providers acting on our behalf for those purposes.
- Comply with law and enforce these Terms.
This license ends when Your Content is deleted from our active systems, except to the extent limited copies must remain temporarily in backups or are retained as required or permitted by law.
You represent and warrant that:
- You own Your Content or have all rights, licenses, permissions, and lawful bases necessary to submit and process it.
- Your use of the Service and Your Content does not infringe copyright, privacy, publicity, voice, trademark, contractual, or other rights.
- You have obtained any consent required to record, upload, transcribe, identify speakers in, or otherwise process communications involving other people.
- Your Content and use of the Service comply with applicable law and these Terms.
Public availability of a URL does not by itself mean that you have permission to copy, transcribe, publish, or commercially use the underlying content. You are solely responsible for determining whether your intended use is lawful.
6. Transcripts and Outputs
Subject to these Terms and any third-party rights in the underlying content, you may use the transcripts, subtitles, and exports generated for you by the Service ("Outputs").
Automated transcription and speaker detection are probabilistic. Outputs may be incomplete, inaccurate, offensive, misleading, or unsuitable for your intended purpose. You are responsible for reviewing Outputs before relying on, publishing, or sharing them.
Do not use an Output as the sole basis for medical, legal, employment, credit, insurance, housing, education, safety-critical, or other high-impact decisions. HiTranscript does not provide professional advice.
Outputs may not be unique, and other users may receive similar results. HiTranscript does not represent that an Output is eligible for copyright protection or free of third-party rights.
7. Acceptable Use
You may not use the Service to:
- Violate any law, regulation, court order, contract, or third-party right.
- Submit content you are not authorized to access, record, upload, copy, or process.
- Circumvent authentication, access restrictions, paywalls, encryption, or technical protection measures.
- Upload malware, malicious code, or content intended to disrupt or compromise systems or users.
- Generate, store, or distribute child sexual abuse material, unlawful sexual content, terrorist content, or material that unlawfully exploits or endangers a person.
- Harass, threaten, defame, impersonate, discriminate against, or unlawfully surveil another person.
- Collect or expose personal information without a lawful basis or required consent.
- Probe, scan, reverse engineer, overload, scrape, or interfere with the Service, except where applicable law expressly permits an activity that cannot be restricted by contract.
- Evade rate limits, credits, security controls, suspensions, or account restrictions.
- Resell, transfer, or commercially exploit access to the Service or credits except under a separate written agreement with HiTranscript.
- Use the Service or Outputs to develop or train a competing transcription service or model through systematic extraction or automated collection.
We may investigate suspected violations and remove content, restrict processing, revoke fraudulently obtained credits, suspend accounts, or cooperate with lawful authorities where appropriate.
8. Credits, Purchases, and Billing
HiTranscript currently offers one-time credit purchases. Credit packs are not subscriptions and do not automatically renew.
Prices, included credits, currency, taxes, and material purchase terms are shown at checkout. We may change prices or credit usage rules prospectively, but a change will not reduce the number of credits already credited to your account or shorten their stated expiration period.
Unless a different period is clearly stated at purchase:
- Paid credits expire 365 days after they are granted.
- Promotional or free credits may have a shorter stated expiration period.
- Credits have no cash value, do not earn interest, and may not be sold, transferred, or redeemed for cash.
- Credits are consumed according to the duration, feature, and billing interval applicable when a task is processed. A partial billing interval may be rounded up to a full interval as disclosed by the Service.
- If a charged task ends in a system-recorded processing failure, the credits consumed for that task are normally restored automatically. A credit restoration is not a cash refund.
Except where applicable law requires otherwise, purchases are final and non-refundable. Used or expired credits are not refundable. We may grant a refund or service credit at our discretion, but doing so once does not require us to do so again.
If mandatory consumer law gives you a cancellation, withdrawal, refund, or other non-waivable right, that right remains unaffected. By requesting immediate processing, you request that the digital service begin before any applicable withdrawal period expires and acknowledge that using credits may affect a right to cancel, to the extent permitted by law.
You authorize our payment processor to charge the payment method you select. You are responsible for applicable taxes, valid billing information, and charges authorized through your account. We may reject, cancel, or reverse a transaction affected by error, suspected fraud, illegality, or unauthorized use. Improper chargebacks or payment disputes may result in suspension while the matter is investigated.
9. Intellectual Property
The Service, including its software, design, branding, interfaces, documentation, and other materials provided by HiTranscript, is owned by or licensed to HiTranscript and is protected by intellectual property law.
Except for the limited right to use the Service under these Terms, no right or license to the Service or HiTranscript branding is granted to you. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service except as expressly permitted by us or by non-waivable law.
Feedback you voluntarily provide may be used by HiTranscript without restriction or compensation, provided we do not publicly identify you as its source without permission.
10. Copyright Complaints
If you believe content processed or stored through the Service infringes your copyright, email support@hitranscript.com with:
- Identification of the copyrighted work.
- Identification and location of the allegedly infringing material.
- Your name and contact information.
- A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or law.
- A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the rights holder.
- Your physical or electronic signature.
We may remove or disable access to material alleged to infringe and may terminate repeat infringers in appropriate circumstances. We may forward a complaint to the affected user where permitted.
11. Third-Party Services
The Service depends on third-party platforms and service providers. Their terms and privacy policies may apply separately to your dealings with them. HiTranscript is not responsible for third-party content, availability, policies, errors, or actions outside our reasonable control.
You remain responsible for complying with the terms that apply to a source platform and for determining whether your use of content from that platform is permitted.
12. Suspension and Termination
You may stop using the Service or delete your account at any time using available account controls.
We may suspend, restrict, or terminate access, remove content, or refuse processing if we reasonably believe that:
- You violated these Terms or applicable law.
- Your use creates security, legal, reputational, or operational risk.
- Your account or payment activity is fraudulent or unauthorized.
- Suspension is necessary to protect users, third parties, or the Service.
- We are required to do so by law or a service provider on which the Service depends.
Where reasonably practicable, we will provide notice and an opportunity to address the issue. Immediate action may be taken for urgent, repeated, fraudulent, illegal, or dangerous conduct.
To the extent permitted by law, unused promotional credits and credits obtained through fraud or abuse may be revoked. Purchased credits may be forfeited when an account is terminated for a material violation, except where applicable law requires otherwise.
Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions—will survive.
13. Disclaimers
To the maximum extent permitted by law, the Service and Outputs are provided "as is" and "as available." HiTranscript disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
We do not warrant that a submitted source will remain available, that a third-party platform will permit access, that every file can be processed, that every speaker will be identified correctly, or that any Output will meet your requirements.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, HiTranscript will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, business, goodwill, or data; business interruption; cost of substitute services; or damages arising from inaccurate Outputs or third-party platforms, even if advised that such damages were possible.
To the maximum extent permitted by law, HiTranscript's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:
- US$100; or
- The amount you paid to HiTranscript during the twelve months immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory and apply in the aggregate, not per claim. They do not apply to liability that cannot be limited or excluded under applicable law.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless HiTranscript and its operators, affiliates, contractors, service providers, and representatives from third-party claims, damages, liabilities, losses, judgments, costs, and reasonable legal fees arising from:
- Your Content or Outputs you publish, share, or use.
- Your violation of these Terms or applicable law.
- Your infringement or violation of another person's intellectual property, privacy, publicity, voice, contractual, or other rights.
- Your misuse of the Service or unauthorized activity under your account.
We may control the defense and settlement of a covered claim, and you agree to provide reasonable cooperation. We will not settle a claim in a way that imposes an admission or non-monetary obligation on you without your consent, not to be unreasonably withheld.
16. Dispute Resolution
Before starting formal proceedings, you agree to contact support@hitranscript.com and attempt in good faith to resolve the dispute informally for at least 30 days. This requirement does not prevent either party from seeking urgent injunctive relief or using a qualifying small-claims procedure.
If a dispute is not resolved informally, either party may bring a claim in a court that has jurisdiction under applicable law. Nothing in these Terms limits any non-waivable consumer right or allows a claim to be brought in a court that lacks jurisdiction. To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within one year after the claim arose; otherwise, the claim is permanently barred.
17. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security needs, or business practices. We will post the revised Terms and update the date above. If a change materially reduces your rights, we will provide additional notice where required.
Changes apply prospectively from their effective date. Your continued use of the Service after that date constitutes acceptance of the revised Terms where permitted by law.
18. General Terms
These Terms and the Privacy Policy constitute the entire agreement between you and HiTranscript regarding the Service, except for any separate written agreement that expressly applies.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, war, labor disputes, government action, Internet or utility failure, cyberattack, or failure of a third-party platform or provider.
If a provision is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. Headings are for convenience only.
